Terms and Conditions

Welcome to Seka!
The following terms and conditions apply to your use of the Seka platform, including the Seka website, applications, and any content, functionality, and services (specifically our AI novel translation services) offered on or via Seka.
Please read the Terms and Conditions carefully before you start using Seka. By using the Website, Application, or Extension, you accept and agree to be bound and abide by these Terms and Conditions.
Account Registration and Security
To access and use certain features of Seka, you must register for an account. You may register using a valid email address, or through supported third-party authentication services, specifically Google and Apple.
By registering via a third-party service (Google or Apple), you authorize us to access and use your basic profile information (such as your name and email address) as permitted by that service to create and maintain your Seka account.
You are entirely responsible for maintaining the confidentiality of your account credentials (including your email password or third-party account security) and for any and all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Seka will not be liable for any loss or damage arising from your failure to comply with this security obligation.
Points and Payments
- Seka operates on a pay-as-you-go basis using a virtual credit system called "Points".
- Users may purchase (recharge) Points through our approved payment gateways.
- Translation fees are deducted from your account balance in Points based on the volume of text (for example character or word count) translated by our AI.
- Points have no cash value outside of the Seka platform and cannot be exchanged for real currency, except as explicitly stated in our Refund Policy.
Refund Policy
Unless otherwise required by the applicable law, no refund will be entertained after the virtual items has been purchased.
Content
Your Content
You may provide input to the Services ("Input"), and receive output from the Services based on the Input ("Output"). Input and Output are collectively "Content." You are responsible for Content, including ensuring that it does not violate any applicable law or these Terms.
You represent and warrant that you have all rights, licenses, and permissions needed to provide Input to our Services. You agree not to submit any Content that:
- infringes any intellectual property or other proprietary rights of any party;
- you do not have a right to submit;
- contains software viruses or any computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- poses a privacy or security risk to any person;
- constitutes unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, "junk mail," "spam," "chain letters," "pyramid schemes," "contests," "sweepstakes," or any other form of solicitation;
- is threatening, abusive, harassing, tortious, bullying, or excessively violent;
- is defamatory, libelous, or verifiably false with the purpose of harming others;
- constitutes hate speech that demeans or promotes discrimination or violence on the basis of race, ethnicity, gender, religion, age, or other social, physical or mental characteristics;
- is obscene or pornographic;
- constitutes sexual harassment;
- constitutes sexual exploitation or abuse of a minor, including sharing child sexual exploitation or abuse imagery or content, grooming, or sexual extortion;
- glorifies self-harm, including self-injury, suicide, or eating disorders;
- promotes terrorism or violent extremism;
- furthers or promotes criminal activity;
- seeks to buy or sell illegal drugs;
- facilitates fully automated decision making that adversely impacts a person’s legal rights or creates a binding, enforceable obligation;
- seeks to provide medical, legal, financial or tax advice;
- interferes with or disrupts the Services or servers or networks connected to the Services;
- interferes with or appropriates any person’s right of publicity by using their name, likeness or persona (a) without permission and (b) outside a permissible context such as non-commercial parody or public commentary; or
- in the sole judgment of Seka, is objectionable or that restricts or inhibits any other person from using or enjoying the Services, or which may expose Seka or its users to any harm or liability.
Similarity of Content
Due to the nature of our Services and artificial intelligence generally, output may not be unique and other users may receive similar output from our Services. Our assignment above does not extend to other users’ output or any Third Party Output.
Our Use of Content
We may use Content to provide, maintain, develop, and improve our Services, comply with applicable law, enforce our terms and policies, and keep our Services safe.
Accuracy
Artificial intelligence and machine learning are rapidly evolving fields of study. We are constantly working to improve our Services to make them more accurate, reliable, safe, and beneficial.
Given the probabilistic nature of machine learning, use of our Services may, in some situations, result in Output that does not accurately reflect real people, places, or facts.
Intellectual Property
When you submit Content to the Services, you represent and warrant that you own all right, title and interest in and to that Content (including, without limitation, all copyrights and rights of publicity), or that you have received all necessary permissions, clearances, and authorizations in order to submit it to the Services for the uses contemplated in these Terms.
When you submit such Content, you retain whatever ownership rights in that Content you had to begin with. You grant Seka, to the fullest extent permitted under the law, a nonexclusive, worldwide, royalty-free, fully paid up, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, transmit, make available, store, modify, exploit, commercialize and otherwise use the Content for any Seka-related purpose in any form, medium or technology now known or later developed, including without limitation to operate, improve and provide the Services.
You agree that these rights and licenses include a right for Seka to make the Content available to, and pass these rights along to, others with whom we have contractual relationships, and to otherwise permit access to or disclose the Content to third parties if we determine such access is or may be necessary or appropriate.
While we’re not required to do so, we may access, review, screen, edit, modify and delete your Content at any time and for any reason, including to provide and develop the Services or if we think the Content violates these Terms or any applicable laws.
Copyright Complaints
We respect the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify us of your infringement claim in accordance with the procedure set forth below.
DMCA Notices. We will process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws with respect to any alleged or actual infringement. A written notification of claimed copyright infringement should be e-mailed to: support@seka.one.
Third-Party Websites and Services
This platform may link you to other sites on the Internet or otherwise include references to information, materials and/or services provided by other parties (including our authentication partners, Google and Apple).
These other websites and parties are not under our control, and you acknowledge that we are not responsible for the accuracy, privacy practices, copyright compliance, legality, or any other aspect of the content or services of such sites. The inclusion of such a link, reference, or login integration is provided merely as a convenience and does not imply endorsement of, or association with, the Website or party by us.
Third Party Material
Under no circumstances will Seka be liable for any content or materials of any third parties. This includes, but is not limited to, infringement of intellectual property rights, errors or omissions in any content, and any loss or damage of any kind incurred as a result of the use of any such content.
You acknowledge that we do not pre-screen content and that AI-generated chats, by their nature, are unpredictable and may produce Output that are inaccurate or offensive. You agree that you must evaluate, and bear all risks associated with, the use of any Content. You should not rely on the accuracy or completeness of statements made in Content, and if you do so, you acknowledge that it is at your own risk.
Disclaimer of Warranties, Limitations of Liability and Indemnification
Your use of Seka is at your sole risk. The platform and its AI translation services are provided "as is" and "as available". We disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, translation accuracy, and non-infringement.
We are not liable for damages, direct or consequential, resulting from your use of Seka. You agree to defend, indemnify and hold us harmless from any claims, losses, liability costs and expenses (including but not limited to attorney's fees) arising from your violation of any third-party's rights, specifically including copyright infringement claims arising from texts you chose to translate.
You acknowledge that you have only a limited, non-exclusive, nontransferable license to use Seka. Because the platform utilizes AI and is not error or bug-free, you agree that you will use it carefully and avoid using it in ways which might result in any loss of your or any third party's property or information.
Term and Termination
These Terms and Conditions will become effective in relation to you when you create a Seka account (via email, Google, or Apple) or when you start using Seka and will remain effective until terminated by you or by us.
You may terminate this Agreement at any time by emailing us at the provided support email to delete your Account and related data. If you terminate your Account, we will cancel any remaining Points associated with your Account without a refund.
Seka reserves the right to terminate these Terms and Conditions or suspend your account at any time in case of unauthorized, or suspected unauthorized use of the platform whether in contravention of these Terms and Conditions or otherwise. If Seka terminates these Terms and Conditions, or suspends your account for any of the reasons set out in this section, Seka shall have no liability or responsibility to you.
Changes
We reserve the right, at our sole discretion, to change or modify portions of these Terms at any time. If we do this, we will post the changes on this page and will indicate at the top of this page the date these terms were last revised. Any such changes will become effective no earlier than 7 days after they are posted, except that changes addressing new functions of the Services or changes made for legal reasons will be effective immediately. Your continued use of the Services after the date any such changes become effective constitutes your acceptance of the new Terms.
If you continue to use our services after the changes are posted, you consent to the updated Terms. If you do not agree with the changes, you have the right to discontinue use of Seka.
